資格外活動許可とは
資格外活動許可とは、「就労」や「留学」等の在留資格で在留する外国人が、許可された在留資格に応じた活動以外の収入・報酬をともなう活動を行おうとするときに必要な許可です。対象は入管法別表第一の在留資格(就労資格を有する方や留学生等)に該当する方です。例えば外国人留学生が資格外活動許可を受けることなくアルバイトなどを行った場合、本人は不法就労罪に外国人を雇った者にも不法就労助長罪が成立します。

勤務場所や活動内容が決まる前から申請することができます。また、勤務先がかわるごとに、許可を取り直す必要はありません。
留学生の場合、労働時間は１日あたり８時間で週２８時間以内にする必要があります。なお夏休みなどの長期休暇中は１日あたり８時間、週４０時間以内に制限が拡大されます。風俗営業法の対象となる仕事はすることはできません。
